Terms and Conditions

1. Scope

These Terms and Conditions apply to all contracts, services, and offers between the photo studio [Name] (hereinafter referred to as "Photo Studio") and its clients (hereinafter referred to as "Client"), unless otherwise explicitly agreed.

2. Appointment Booking

Appointments for photo shoots are scheduled via our online registration form, by phone, or by email. By booking an appointment, the Client acknowledges these Terms and Conditions.

The Photo Studio reserves the right to reschedule appointments at short notice for valid reasons (e.g., illness, technical issues). In such cases, an alternative date will be offered. Claims for compensation are excluded.

3. Services and Prices

The offered services (e.g., type and duration of the shoot, number of images) and the respective prices are listed on our website or in individual quotes. All prices are in euros and include statutory VAT.

Changes to services after the conclusion of the contract are only possible with mutual consent. Special requests (e.g., specific props, locations, edits) must be agreed upon in writing in advance.

4. Payment

Payment is to be made by bank transfer, cash, or digital payment services (e.g., PayPal), as agreed. Unless otherwise specified, payment is due no later than the day the service is provided.

In the event of late payment, the Photo Studio reserves the right to withhold delivery of images or access to cloud links.

5. Delivery of Photos

Final images will be provided to the Client either on a USB stick or via a password-protected cloud link. Cloud access is available for 14 days from the date of delivery. Extensions are possible upon request.

The Photo Studio assumes no liability for data loss caused by third parties or improper storage by the Client.

6. Image Editing

All images included in the service package will be delivered in a basic optimized version (e.g., brightness, contrast, cropping). Upon request and depending on the selected package, advanced editing (e.g., skin retouching, color grading, element removal) can be provided.

Additional edits beyond the agreed scope are subject to separate fees.

RAW files (unedited image data) will not be provided unless explicitly agreed upon.

7. Gift Vouchers

The Photo Studio offers gift vouchers for various services. These are valid for three years from the date of issue and are transferable.

Cash payouts are excluded. Vouchers must be declared during booking and presented at the latest at the photo shoot. No replacement is provided in the case of loss or theft.

8. Usage Rights

Unless otherwise agreed, the Client receives a simple, non-transferable right to use the delivered images for private purposes (e.g., printing, personal website, social media).

Any commercial use (e.g., advertising, resale, press publications) requires prior written consent from the Photo Studio.

The Photo Studio reserves the right to use images for self-promotion (e.g., website, social media, portfolios, exhibitions) – but only with the Client's written consent in accordance with Art. 6(1)(a) GDPR.

9. Right of Withdrawal

Consumers, as defined by § 13 BGB (German Civil Code), have a statutory right of withdrawal of 14 days for off-premises or distance contracts. The withdrawal must be made in writing.

Note: The right of withdrawal expires if the photo shoot is fully performed before the withdrawal period ends and the Client has expressly agreed to this (§ 356(4) BGB).

10. Liability

The Photo Studio is liable only for damages caused by willful intent or gross negligence.

No liability is accepted for:

Damage or loss due to force majeure (e.g., power outage, fire)
Technical failures beyond our control
Delays or data errors caused by third-party providers

11. Data Protection

The provisions of the privacy policy on our website apply. Personal data is processed solely for the purpose of fulfilling the contract and will not be shared with third parties unless necessary for service delivery (e.g., cloud providers).

12. Final Provisions

If any provision of these Terms and Conditions is or becomes invalid, the remaining provisions shall remain unaffected. The invalid provision shall be replaced with one that most closely reflects the economic intent.

The law of the Federal Republic of Germany applies. The place of jurisdiction, where legally permissible, is the registered office of the Photo Studio.
